Terms of Service

Bug Smash is a product of ArusLogic, a division of ARUS ENTERPRISES LLC. These terms are an agreement between you and ARUS ENTERPRISES LLC, a Wyoming limited liability company (“we”, “us”), for the Bug Smash website, web app, API, command-line tool (smash), browser extension and agent skill (together, the “Service”).
By creating an account, signing in, or paying for a plan, you agree to these terms, the Acceptable Use Policy and, where it applies, the Data Processing Addendum. Our Privacy Policy explains how we handle personal data. If you use the Service for a company, you agree for that company and confirm you can bind it; “you” then means the company.
1. Who can use Bug Smash
The Service is for businesses and professionals testing their own software. You must be at least 18 and able to form a binding contract. You may not use it if you are barred by US law, or are in, or acting for someone in, a country or region under comprehensive US sanctions.
2. Your account
- Give us accurate details and keep them current. One person per account.
- Keep your password, API tokens and CLI or extension sign-ins secret. You are responsible for what happens under your account and tokens. Revoke a token under Account → API tokens if it leaks, and tell us at support@bugsmash.dev if you suspect misuse.
- Workspace owners control their workspace: who joins, their roles, the plan and billing, and its data. Members' and viewers' access ends when an owner removes them.
3. Plans, billing and renewal
- The Free plan costs nothing. Paid plans (Pro at $10 and Team at $35 a month per workspace, plus any tax) are billed in advance through Stripe, our payment processor.
- Paid plans renew automatically every month and charge the card on file until you cancel. You can cancel at any time under Workspace settings → Billing (Manage billing). Cancelling stops the next renewal; your plan stays active until the end of the period you've paid for, then the workspace moves to Free.
- We may change prices. We'll email workspace owners at least 30 days before a new price applies to them; it starts at your next renewal after that, and you can cancel before then.
- Prices exclude taxes. We collect sales tax, VAT or GST where the law requires it; business customers can add a tax ID at checkout.
- If a payment fails, Stripe retries it. While it's unpaid, or after a plan ends, a workspace over the Free plan's limits becomes read-only. Nothing is deleted except as described in section 7.
4. Refunds
Payments are non-refundable and we don't give credit for part of a month, except where the law requires otherwise or we decide to in a particular case. If you were charged by mistake or something went wrong, write to support@bugsmash.dev within 30 days and we'll look at it. Deleting your account cancels its paid workspaces with a prorated credit for the unused time.
5. Your content
- “Your content” is what you and your workspace put into the Service: projects, bugs, notes, screenshots, traces, videos, console logs and captures. You own it. You give us a licence to host, copy, process and show it only to run, secure and support the Service for you, and as the law requires. We don't sell it, and we don't use it to train AI models.
- You are responsible for your content and for having the right to collect it, including any personal data of other people that appears in screenshots, traces or logs. Hide private details before you send them (the extension lets you paint over parts of a screenshot). Where your content includes personal data, the Data Processing Addendum applies and we process it on your instructions.
- Coding agents you connect (for example through the CLI, the agent skill or MCP) act on your behalf. Their providers are your choice and are not our subprocessors.
- If you send us feedback or ideas, we may use them without owing you anything.
6. Acceptable use
Bug Smash drives real browsers against websites. Use it only on sites and apps you own or are authorised to test, and follow the Acceptable Use Policy. We may remove content or suspend access that breaks it.
7. Data retention and deletion
- Files (screenshots, traces, videos) are kept for your plan's history window: 30 days on Free, one year on paid plans, with a 30-day grace period after a paid plan ends. Older files are deleted automatically.
- You can delete projects, workspaces you own, and your account at any time. Deleting your account deletes the workspaces where you are the only member.
- Deleted data leaves our live systems straight away and our backups within 30 days, except records we must keep by law (such as invoices, which Stripe keeps).
- You can ask for an export of your data at support@bugsmash.dev.
8. The software and our rights
- While you follow these terms, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the
smashCLI, the browser extension and the agent skill to use the Service. - The Service, its software, design and the Bug Smash name and logo belong to us or our licensors. Don't copy, resell, or reverse-engineer them, or build a competing service from them, except where the law allows despite this.
- The CLI includes open-source components, such as Playwright, under their own licences; see Open-source notices. Those licences win over these terms for those components.
- Integrations and third-party services you connect are governed by their own terms.
9. Changes to the Service and these terms
We improve the Service all the time and may change or remove features. If we change these terms in a way that matters, we'll email account holders or show a notice in the app at least 30 days before the change takes effect, unless it is required sooner by law or to deal with misuse. If you keep using the Service after that, you accept the new terms. If you don't, cancel and stop using it before then.
10. Suspension and ending
- You can stop using the Service and delete your account at any time.
- We may suspend or end your access if you break these terms or the Acceptable Use Policy, don't pay, create risk or legal exposure for us or others, or if we stop offering the Service. Where reasonable we'll warn you first and give you time to export your data. If we stop the Service for everyone, we'll give at least 30 days' notice and refund prepaid time we can't provide.
- Sections 4, 5 (feedback), 8, 11, 12, 13 and 14 survive the end of this agreement.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. Bug Smash helps you find bugs; it doesn't promise to find all of them, that your software is free of defects, or that the Service will be uninterrupted or error-free. We don't offer a service-level agreement.
12. Limitation of liability
To the fullest extent the law allows: neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and each party's total liability arising from or relating to the Service or these terms is limited to the greater of the amounts you paid us in the 12 months before the claim and US$100. These limits don't apply to your payment obligations, your breach of the Acceptable Use Policy, or either party's obligations under section 13, and don't limit liability that can't be limited by law.
13. Indemnity
You will defend and indemnify ARUS ENTERPRISES LLC and its members, employees and agents against third-party claims, and the resulting losses and reasonable costs, arising from your content, or from your use of the Service against sites or systems you weren't authorised to test, or in breach of these terms.
14. Law and disputes
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. The courts located in Wyoming have exclusive jurisdiction, and both parties consent to them. If you are a consumer in a country whose law gives you the right to sue at home or under its law, nothing here takes that away. The UN Convention on Contracts for the International Sale of Goods does not apply.
15. General
- These terms, the policies they link to, and any order form you sign with us are the whole agreement about the Service.
- If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver.
- You may not transfer this agreement without our consent. We may transfer it to an affiliate or as part of a merger or sale of the business.
- Neither party is liable for delays caused by events beyond its reasonable control.
- We send notices to your account email or in the app. Send notices to us at support@bugsmash.dev or by post to the address below.
